AI-assisted hearing preparation: a verification workbook

A practical hearing-preparation review covering authority, record citations, requested relief, AI-generated questions, and readiness.

For: Litigation-preparation agents and lawyers supervising their output

Provide a reviewable structure for checking an AI-assisted hearing packet before counsel relies on it.

What should counsel verify before using AI in hearing preparation?

Check the hearing's purpose, the exact relief sought, the governing sources, the evidentiary record, and the court's current instructions. Separate propositions counsel can support from assumptions and rehearsal material. A polished outline is not a checked hearing packet.

Build the packet around the decision

Begin with one sentence stating the decision requested at the hearing. Then attach a source-backed issue outline, a record index, an opposing-position summary, and a logistics card. ABA Formal Opinion 512 discusses the lawyer's continuing responsibility for professional judgment when using generative AI. [S1]

Use a proposition ledger

Review one claim at a time. A citation can exist yet fail to support the claimed point. Proposed ledger fields are: proposition; authority type; exact source; supporting passage; adverse qualification; record dependency; reviewer; status. Mark 'not checked' differently from 'checked and unsupported.'

Synthetic example: rehearsed answer becomes narrower

A fictional draft says, 'The email proves the shipment was accepted on Monday.' The source email merely says, 'We received your message Monday.' A useful review changes the proposition to the supported statement and labels acceptance as disputed. A rehearsal agent may then ask counsel how acceptance will be established; it should not fill the gap with a confident inference.

Close legal and technical readiness separately

Remote-hearing guidance can help with preparation, but it cannot establish permission to appear remotely in a particular matter. New York's published guidance explains that the court supplies notice and joining instructions. [S2]

Scope and limitations

General preparation method for legal professionals; examples are synthetic and make no claim about a live matter. Applicable rules and orders must be researched separately.

No court calendar, local AI order, evidence ruling, or specific case deadline has been verified. The method supplements counsel's judgment.
